Casino Worries Similar Logos for Casino and Chadds Ford Newsletter Might Confuse People

Emily Myers was pleased when she found a particular font for the “Live” part of her Chadds Ford Live logo on her online newsletter, writes Christian Hetrick for The Philadelphia Inquirer.   

 “It just looked like it was made for that word,” Myers said.

Now the owners of Philadelphia’s newest casino, Live! Casino and Hotel Philadelphia, say she can’t use it, afraid it will confuse consumers with their trademarked logo.  

Myers, not wanting a costly, lengthy legal battle, agreed to change the logo.

 But the casino’s request might actually have been the harder legal battle, law professors say.

 “There’s a real hurdle to showing there’d be any sort of consumer confusion,” said Paul Gugliuzza, a Temple University law professor. “When you see the word ‘Live’ plastered on the side of a casino, you’re not thinking ‘Oh, that same company is behind this local newsletter’ and vice versa.”

Two similar logos wouldn’t’ decide the case.

Even so, Chadds Ford Live is busy redesigning its logo, updating its website, and replacing pens and credit card holders that had the mark.

“We have a whole lot of references to Chadds Ford Live,” Myers said. “It’s no small job.”
