From CHESCO: Crebilly Farm Saga Continues as Toll Brothers Appeals Denial of Building Permit

The Crebilly Farm saga continued last week as Toll Brothers appealed the decision by Westtown Township to deny it a permit to develop more than 300 apartments on the Chester County property, writes Caitlin McCabe for the Philadelphia Inquirer.

The Horsham-based developer of luxury homes asked a Chester County Court judge to reverse the decision made by the local board of supervisors and approve Toll’s application to build.

“The reasons for denial set forth in the board’s decision constitute an abuse of the board’s discretion, are improper as a matter of law, and are not supported by substantial evidence,” states the appeal.

The appeal was submitted nearly a month after the supervisors released their explanation on the denial. In it, they cited various reasons, including road placement concerns, traffic, disruption of the scenic views, and the property’s potential ties to the Battle of Brandywine.

Toll’s plans for the property include 317 new homes, 200 of which would be single-family homes, leaving more than 60 percent of the 322-acre property as open space.
