Wawa Agrees to Pay $1.4 million Settlement in Overtime Dispute

Some Wawa assistant general managers who claimed they should have been paid overtime will be receiving money as part of a class action settlement, writes Jim Walsh for the Courier-Post.

Assistant general managers who worked between January 2014 and the end of 2015 will receive an average of $4,268.29, part of the $1.4 million settlement.

About $900,000 will go to 328 current and former assistant general managers.  Another $467,000 will go to the workers’ attorneys.

The settlement has additional payments of $5,000 each for a handful of workers who brought the suit in January 2017, including Anthony Gervasio of Riverside.

The lawsuit sought overtime pay, claiming Wawa improperly considered the employees to be exempt.  It asserted Wawa violated a federal wage law, and state laws in New Jersey, Pennsylvania and Maryland.

Wawa denied any wrongdoing in settling the suit. The firm changed the workers’ classification to allow overtime pay in December 2015, a court filing notes.

The settlement represents “a very good and immediate result,” said the filing by an attorney for the employees, Marc Hepworth of New York City.

U.S. District Judge Peter Sheridan approved the settlement, which includes $18,000 for administrative expenses.
