Pennsylvania Supreme Court to Hear Case on Closing of DCMH

The Pennsylvania Supreme Court will hear a case regarding the closing of DCMH in Drexel Hill.

The Pennsylvania Supreme Court has agreed to hear an appeal over Prospect Medical Holdings Inc.’s closing of Delaware County Memorial Hospital in Drexel Hill, writes Harold Brubaker for The Philadelphia Inquirer.

Crozer Health is the largest healthcare provider in Delaware County, and the closing of DCMH has impacted local patients.

The hospital was closed by Prospect Medical in the fall of 2022 despite a lower court’s order that it stay open.  The Commonwealth Court overturned the lower court’s emergency preliminary injunction that the hospital be open.

The state Supreme Court said it will consider whether the Commonwealth Court erred when it overturned the injunction “on the grounds that there was insufficient evidence of irreparable harm.”

The Supreme Court decision on Dec. 13 ends an October agreement between Prospect and The Foundation for Delaware County that legal action would be suspended for nine months so Prospect Medical could find a buyer for Crozer Health, operator of DCMH.

“We’re delighted with the action of the court,” said Rocco P. Imperatrice III, a lawyer for the foundation, the legal successor to the nonprofit that owned the former Crozer-Keystone Health System.
