Prospect Files to End Hospital Injunction, Projects $2M Loss Per Month

The latest volley in the battle to determine the fate of Delaware County Memorial Hospital came from Prospect Medical Holdings this week.

The parent company of Crozer Health filed a motion to remove an injunction now blocking plans to convert the acute care hospital in Drexel Hill to a behavioral health facility, writes John George for Philadelphia Business Journal.

Prospect Medical said it will lose $2 million a month if it can’t make changes to the hospital, according to the Commonwealth Court motion.

The Foundation for Delaware County, which filed for the injunction, argues Prospect can’t close a Crozer hospital for at least 10 years or before June 30, 2026 and that it needs its consent to close the hospital.

Prospect said the hospital is not closing but transitioning to inpatient behavioral health services and urgent care.

Since the injunction was imposed, the Pennsylvania Department of Health ordered DCMH’s emergency room closed and no further admissions at the hospital due to inadequate staff.

“Absent a stay, Prospect will be stuck in an impossible situation: ordered by the trial court to keep its emergency department open, while the Department of Health orders that it remains suspended,” Prospect’s motion stated.
